Terms of Service

The agreement between you and Mobile Cosmos LLC when you use Privacy VPN.

By installing or using Privacy VPN (the “Service”), offered by Mobile Cosmos LLC (“we”, “us”), you agree to these terms. If you do not agree, do not use the Service.

The service

Privacy VPN is a mobile app for iPhone, iPad and Android that routes your device’s internet traffic through an encrypted connection to our servers. It also includes an optional ad and tracker blocker and a private browser. These terms cover the apps, our servers and this website.

Who can use it

You must be at least 13 years old, or have the consent of a parent or legal guardian. The Service is for people: accounts created or operated by bots or other automated means are not allowed and will be closed.

Your account and devices

You do not sign up with a name or email address. When you first open the app, it creates an anonymous account linked to a random identifier of your device. Your account number and Device ID are shown in the app’s Settings; keep them if you contact us.

A subscription can be used on one device at a time. If you restore your purchase on another device, the subscription moves to that device and the previous one is disconnected.

Acceptable use

You may not use the Service for anything that is illegal where you or the affected party is. In particular, you agree not to use it to:

  • access, share, download or upload illegal content, including any material depicting the sexual abuse of children;
  • harass, threaten, defame, or discriminate against anyone;
  • send spam or other unsolicited messages;
  • access or probe computers or networks without authorization, or distribute malware;
  • infringe intellectual property rights;
  • overload, attack or disrupt our servers or other people’s use of the Service, or resell access to it.

We do not monitor what you do through the Service and keep no record of it (see our Privacy Policy). If we learn that an account is being used in breach of these rules, for example through a court order or abuse of our servers, we may suspend or close it without notice. You are responsible for damages you cause by such use.

Subscriptions and free trials

Connecting through our servers requires a Premium subscription. Subscriptions are sold and billed by Apple (App Store) or Google (Google Play) under their terms, in the plans shown in the app (for example weekly, monthly or yearly).

  • Automatic renewal. A subscription renews at the end of each period at the same price and for the same length, unless you cancel it at least 24 hours before the period ends.
  • Free trials. If a plan offers a free trial, it turns into a paid subscription when the trial ends unless you cancel before then. You are told the trial length and the price that follows before you start.
  • Offer codes. Promotional codes are redeemed in the App Store or Google Play and follow the terms shown there.
  • Cancelling. Cancel in your device’s subscription settings (App Store: Settings > your name > Subscriptions; Google Play: Play Store > Payments & subscriptions). Deleting the app does not cancel a subscription. After cancelling, Premium stays active until the end of the period you paid for.

Billing and refunds

All payments are processed by Apple or Google. We never see your payment details, and we cannot charge, refund or change a payment ourselves. Refund requests are decided by the store under its own policy:

Availability and changes

We work to keep the Service available, but speeds, server locations and availability can vary and are not guaranteed. Some networks or countries may block VPN connections. We may improve, change or remove features, servers or locations at any time, and the apps may update themselves through the app stores.

Warranties and liability

The Service is provided “as is” and “as available”. To the extent the law allows, we make no warranties about its reliability, security or fitness for a particular purpose, and we are not liable for indirect or consequential damages, loss of data or profits, or for content, products or services you access through the Service. Nothing in these terms limits liability that cannot be limited by law, or your rights as a consumer under the law of your country.

Indemnification

You agree to hold Mobile Cosmos LLC and its officers, employees and contractors harmless from third-party claims, including reasonable legal fees, that arise from your breach of these terms or your misuse of the Service.

How we handle data is explained in our Privacy Policy, which is part of these terms.

Changes to these terms

We may update these terms. We change the date at the top when we do, and for significant changes we give notice in the app or on this website. If you keep using the Service after a change, the new terms apply.

Governing law

These terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law rules. Courts in Cheyenne, Wyoming, or the United States District Court for the District of Wyoming, have exclusive jurisdiction, except where the law of your country gives you the right to bring a claim where you live. If any part of these terms is found unenforceable, the rest stays in effect.

If you downloaded the app from the App Store, Apple’s Licensed Application End User License Agreement also applies.
